byBESTON Terms and Conditions

These terms apply specifically to the purchase of artworks including limited edition prints, framed works, and custom commissions from byBESTON, owned and operated by Karl Beston, based in Victoria, Australia.

By placing an order through our website (www.bybeston.com), you agree to be bound by these Artwork Terms, in addition to our general Terms of Service and Privacy Policy.

1. Limited Editions & Originality

All artworks sold by byBESTON are part of strictly limited edition runs or custom one-off commissions. Each piece is individually produced and framed with care. A certificate of authenticity with the edition number and artist signature will be provided with the artwork.

We reserve the right to retire an edition at any time and will not reproduce it beyond the stated limit.

2. Ownership & Usage Rights

When you purchase a print or original work from byBESTON:
• You own the physical item, but not the copyright or intellectual property.
• All artwork remains the intellectual property of Karl Beston / byBESTON.
• The work is licensed to you for personal, non-commercial display only.

You may not reproduce, distribute, publish, modify, photograph, or commercialise the artwork in any form — including digital or printed reproductions — without written permission.

3. Final Sale Policy

All purchases are final and non-refundable.

Due to the limited edition nature and the custom production process of our artworks, we do not accept returns for change of mind. This includes framed and unframed works.

We comply with all obligations under the Australian Consumer Law, which may entitle you to a remedy in the event of a major fault or misrepresentation.

4. Damage & Claims

All artworks are professionally packaged for delivery. Upon receiving your order:
• We kindly request that you inspect your artwork within 48 hours of delivery.
• If you notice any damage caused during shipping, email us at contact@bybeston.com with clear photographs of the damage, the packaging and your order number.

If your claim is accepted, we may offer a replacement (if stock is available), a repair, or a refund, at our discretion.

5. Framing & Materials

Where framing is included or offered, please note:
• Framing is carried out to high professional standards but may involve natural variations in timber grain, finish, or materials.
• Such variations are not considered faults, but part of the handcrafted quality of the piece.

We recommend avoiding prolonged exposure to direct sunlight or moisture, and using appropriate wall fixings for display.

6. Custom Commissions

For commissioned works:
• A written agreement (email or otherwise) must be made in advance, including scope, size, and pricing.
• A non-refundable deposit may be required to confirm your commission.
• Custom works are also subject to these Artwork Terms unless otherwise agreed in writing.

7. Delivery & Risk

• Delivery timelines vary by location and will be confirmed at checkout or via email for commissions.
• We are not responsible for delays caused by couriers, customs, or incorrect address entry.

8. Display Responsibility & Indemnity

byBESTON provides professionally framed and packaged artworks; however, once delivered, the responsibility for safe handling, installation, and maintenance rests with the purchaser.

It is your responsibility to:
• Securely mount or display the artwork using appropriate wall fixings or support
• Avoid hanging in areas with excessive moisture, heat, or direct sunlight
• Keep artworks out of reach of children, pets, or areas prone to vibration or disturbance

byBESTON is not liable for any personal injury, property damage, or loss arising from the handling, installation, or display of artworks after delivery.

You agree to indemnify and hold harmless byBESTON / Karl Beston against any claims, liabilities, or expenses (including legal fees) resulting from such incidents.

9. Colour Accuracy Disclaimer

We make every effort to ensure that product images and descriptions on our website accurately represent the artwork you receive. However, please be aware that:
• Colours, tones, and textures may vary slightly depending on your device’s screen settings, display calibration, and lighting conditions.
• What you see on screen may not perfectly reflect the physical artwork in person.

By purchasing, you acknowledge and accept that minor variations in colour or finish may occur, and do not constitute a defect or grounds for return.

10. Legal & Governing Law

These Artwork Purchase Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria.
